Summary

The Gujarat High Court on 5 May 2017 issued notice to the state government on a fresh public interest litigation (PIL) against a windmill park, which is allegedly being constructed close to a reserve forest in Talaja Range.

Manish Bharti Goswami, a Bhavnagar resident and president of the Lion Nature Youth Foundation, submitted the PIL, raising concerns about the potential impact on the lion habitat. The petition alleged that Veer Energy & Infrastructure Limited, an Ahmedabad-based company, was constructing 27 large windmills close to the reserve forest, a crucial habitat for Asiatic lions and other wildlife.

According to the petitioner, the company had received permission in July 2012 to construct the windmill park on 18 hectares of land, with the condition that they maintain a distance of 1.5 km from the reserve forest. However, the windmills were allegedly set up only 200 metres away, leading to a halt in the work. The PIL further alleged that the Chief Forest Conservator in Gandhinagar, in a letter dated 21 December 2016, told the Forest Conservator in Junagadh that the distance between the windmill and the reserved forest should be only 50 m.

“The construction of 27 windmills in this area would be detrimental to the existence of lions and other wildlife in the corridors of the last surviving Asiatic lions in the world,” Anand Yagnik, counsel for the petitioner, was quoted as saying. The plea underscored that the wind farm's construction and the movement of heavy vehicles would cause irreparable damage to wildlife, including Asiatic lions and various bird species.

It is alleged that the land allocated for the windmill project was government wasteland, surrounded by grazing land in some areas. The plea referenced data indicating that 25 Asiatic lions and 121 leopards had died due to unnatural causes, with electrocution being a significant factor. The presence of transformers in the area posed an imminent danger to the wildlife.
