In Gujarat's Bhavnagar, installation of windmills within 500 meters of a primary school and residential units in Talaja village has sparked a controversy.
Soon after KP Energy started developing a wind park in the villages of Sakhvadar, Khanderi, and Sartanpar in Talaja taluka, a public interest litigation (PIL) challenged the construction, given its proximity to a primary school and residential houses. The petitioner argued that such construction poses significant health and safety risks.
On 3 August 2024, the Gujarat High Court directed the chairman of the Gujarat Energy Development Agency (GEDA) to conduct an inquiry into the permissions granted for the installation of windmills within 500 meters of a primary school and residential units in a Bhavnagar village.
The petitioner argued that one wind turbine had been constructed within the prohibited 500-meter zone of a primary school and another near houses. However, KP Energy contended that the construction was permissible within 500 meters of a public institution, attempting to classify the primary school as such an institution. The bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi took exception to this argument and noted: "It is not acceptable to us that a primary school can be included in the category of public institution to permit the developer to install a windmill within a 500-meter distance."
This controversy echoes past tensions involving KP Energy in the Bhavnagar district. In 2019, residents of the port-light house area near Mahuva actively protested against the construction of windmills by the company. In the ensuing conflict, eleven workers from the company were injured, leading to police filing complaints against 29 named individuals, both men and women, and a group of 150 unnamed protesters.
The agitators had repeatedly reached out to higher authorities, including the Chief Minister, to voice their opposition to the windmills, citing environmental and community concerns. Despite their efforts, their pleas went unanswered.
