Summary

On 13 June 2025, district administrations of Chümoukedima and Dimapur jointly conducted an eviction drive to clear encroachments from 17.9 acres of land illegally occupied by 22 individuals.

A total of 24 structures, including four RCC buildings, three semi-concrete structures, and 17 thatched houses, were dismantled during the eviction drive. Representatives from tribal bodies, civil society organisations (CSOs) of both districts, and nearby village councils were present as witnesses.

The 22 individuals had previously contested a government notification to vacate the land, which the state maintained was public property officially transferred to the Airport Authority. According to Polan John, Deputy Commissioner of Chümoukedima, Dak number 38 and 40 in Diphupar village was particularly targeted for the eviction. John said that the 22 individuals were in illegal occupation of the Dimapur Airport land as their land documents were of Ekranipathar village, whereas they were actually occupying land at Dak number 38 and 40 of Diphupar village.

The eviction drive was carried out following a verdict by the Gauhati High Court’s Principal Bench on 27 May 2025 in CRP Nos. 104/2024 and 105/2024 that quashed and set aside the temporary injunction granted to the encroachers. This enabled the district administrations of Dimapur and Chumoukedima to execute the eviction orders dated 21 December 2019, and 11 December 2020.

Under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the Commissioner of Police, Dimapur, Kevithuto Sophie, had earlier issued a prohibitory order in relation to the eviction drive.
 
Dimapur Deputy Commissioner Dr Tinojongshi Chang stated that the land, which was originally part of Ekranipathar, was brought under Diphupar jurisdiction post the encroachment through illegal means. He disclosed that a 27-bigha plot that belonged to the government had been altered and falsely recorded as 47 bigha by the encroachers. This alleged tampering of land records is believed to have been done between 2012 and 2015. Officially, all fake land documents pertaining to the occupied area have been revoked.

A Special Investigation Team (SIT) that examined the documents concluded that there was sufficient basis to initiate legal proceedings against 31 individuals — including 25 private citizens and six government officials — under various sections of the Indian Penal Code, such as criminal conspiracy, cheating, and forgery. Following which, an FIR was registered at the State Crime Police Station (SCPS), Police Headquarters, Kohima.

With approval from the competent authority, chargesheets against the 25 private individuals have been filed in the appropriate court in Dimapur. As for the six public servants, the Investigating Officer has submitted a formal request to the Department of Personnel & Administrative Reforms (P&AR) and the Department of Land Records, seeking prosecution sanction as required under legal provisions for government employees.
